Benda Custom Picks is an independent French registered business offering selected custom parts and complete look configurations for Benda Napoleon 125/250, Napoleon 450/500 and Dark Flag V4 riders.

2. Independent parts selection
Benda Custom Picks provides selected custom parts and complete look configurations. We are not affiliated with, endorsed by, or officially connected to Benda, Keeway, MBP or their distributors.
Some products may be supplied through selected specialist suppliers, manufacturers or preparation channels. Benda Custom Picks coordinates the order process, product selection, option confirmation, secure checkout and customer follow-up until delivery.
3. Product information, compatibility and customer-selected details
Before payment, the customer must review the selected motorcycle model, products, quantities, colours, options and total amount shown in the cart. By placing an order, the customer confirms that these order details have been reviewed before payment.
Product photos and videos are used to present the part style, visual result and general configuration. The product description, the compatibility information expressly stated for the ordered product and the confirmed order details form the relevant order record. The customer should not rely on compatibility that has not been expressly stated or confirmed for the motorcycle configuration ordered.
Where installation guidance is supplied, it should be followed carefully. Nothing in these Terms reduces any mandatory consumer rights that may apply where an item, its compatibility information, packaging or installation instructions do not conform to the contract.
4. Payment and order confirmation
Secure payments are processed by Stripe. Depending on the checkout, country, currency, order amount and the customer’s eligibility, Stripe may present card payments and other payment methods, including Klarna. Benda Custom Picks does not store full card numbers or card security codes.
Klarna availability: where Klarna is presented at checkout, approval, the available payment plan, repayment terms and customer communications are determined by Klarna and shown before the customer confirms payment. Benda Custom Picks does not grant credit and does not decide Klarna eligibility. The full order price remains visible before payment.
A payment attempt, checkout confirmation, terms acceptance and payment success page may be recorded for fraud prevention, order follow-up and dispute evidence.
5. Order processing
By accepting the order policy at checkout, the customer authorises the start of order processing after payment confirmation. This does not remove any statutory right of withdrawal or statutory remedy that applies to the contract.
6. Cancellation, withdrawal and voluntary refund requests
A request to cancel an order after payment is reviewed against the actual processing, supplier, allocation, preparation and dispatch status. A cancellation based solely on a change of mind is not automatically accepted once processing has started.
Where a statutory right of withdrawal applies, it remains governed by the applicable mandatory law. For consumer contracts subject to French distance-selling rules, the consumer generally has fourteen days from receipt of the goods to exercise the right of withdrawal, subject to the statutory exceptions. The exception for goods made to the consumer’s specifications or clearly personalised applies only where the legal conditions are met; selecting standard catalogue items or a standard configuration does not, by itself, determine that an exception applies.
To exercise a right of withdrawal, the customer may send an unambiguous statement to support@bendacustompicks.com identifying the order and the goods concerned. Benda Custom Picks will acknowledge receipt on a durable medium. Return instructions and any return costs are handled in accordance with applicable mandatory law and the order record.

7. Delivery and tracking
Delivery estimates are provided for guidance. Tracking information is sent when it becomes available from the supplier, preparation channel or logistics partner. International delivery may be affected by logistics delays, customs controls or local import procedures.
8. Import duties, taxes and local compliance
Unless expressly stated otherwise, local import duties, customs charges, taxes, inspections, registration obligations or local compliance checks may remain the responsibility of the customer in the destination country.
Exhaust systems without road-approval documentation
For selected exhaust products supplied without road-homologation certificate or road-approval documentation, Benda Custom Picks confirms mechanical fitment for the Benda model expressly stated on the relevant product page. Benda Custom Picks does not claim that such an exhaust is road legal, ECE approved, EU approved, emissions compliant or noise compliant for public-road use in any specific country.
Road-use requirements vary by country. Before public-road use, the rider must ensure compliance with applicable local requirements, including registration, inspection, noise and emissions rules. This information concerns local road-use requirements only and does not affect statutory consumer rights.
9. Product concern, technical review and conformity
A report concerning a delivered item should identify the order reference, the specific product concerned, the motorcycle configuration and the issue reported. To assess the report, Benda Custom Picks may reasonably request photographs, a short video, images of the relevant mounting points, the installation guidance used and confirmation that the item, hardware and packaging have not been altered, disposed of or returned.
Receiving a complaint, requesting technical information, forwarding photographs to a supplier or discussing a potential solution does not by itself constitute acceptance of a defect, non-conformity, refund, replacement, cancellation or liability.
At the review stage, the assessment normally concerns the product or products expressly identified in the report. Separate items in the same order remain outside that review unless the reported issue affects them or mandatory law requires a broader remedy.
The customer must not force, drill, modify, dispose of or return an item before written instructions are provided, except where mandatory law requires otherwise. This allows the item and the relevant hardware to be assessed and prevents a return from being opened for the wrong product or configuration.
Where a lack of conformity is established and mandatory consumer law applies, the applicable statutory remedy will be handled for the affected goods. Under French consumer law, conformity is normally sought by repair or replacement, except where another statutory remedy is available in the circumstances. Any reduction of price or resolution is handled only under the applicable legal conditions and cannot be expanded beyond the affected goods unless mandatory law requires it.
10. Statutory consumer rights
Nothing in these Terms excludes, limits or replaces statutory consumer protections that apply to the contract. Consumers may have rights relating to conformity, hidden defects, withdrawal, delivery and remedies under applicable law. A choice of French law does not deprive a consumer habitually resident in another country of mandatory protections that may apply in that country.
11. Support and complaints
For order questions or complaints, contact support@bendacustompicks.com with the order email, request ID or payment reference. The customer should explain the specific item and issue concerned so that the file can be reviewed accurately.
12. Consumer mediation
After first sending a written complaint to Benda Custom Picks, a consumer may refer an eligible dispute free of charge to the designated consumer mediator:

Referral is subject to the mediator’s admissibility rules. The customer should first contact Benda Custom Picks in writing at support@bendacustompicks.com and provide the order reference and the specific issue concerned.
13. Applicable law and jurisdiction
These Terms are governed by French law, without prejudice to mandatory consumer protections that apply in the consumer’s country of habitual residence. Any court jurisdiction is determined under the applicable mandatory rules.
14. Changes to these Terms
Any update is published with its effective date and version. It applies to orders placed after publication, unless a mandatory rule provides otherwise. The version accepted at checkout remains the relevant contractual record for that order.
